Welcome to Pauddha Enterprises. These Terms & Conditions (“Terms”) govern your access to and use of the website, applications, communication platforms, products, and services offered by Pauddha Enterprises (“Company,” “we,” “our,” or “us”). By accessing our website, registering an account, using our services, or interacting with us through any communication channel, including the Meta WhatsApp Business Platform, Rich Communication Services (RCS), SMS, email, or any other digital platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

These Terms are intended to comply with applicable laws of India, including but not limited to the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (where applicable), and the policies and requirements prescribed by Meta Platforms, Inc., Google RCS Business Messaging, and telecommunications service providers.

1. Introduction

Pauddha Enterprises is committed to providing reliable, secure, and professional business communication services. Our platform may include customer engagement solutions, messaging services, business communication tools, WhatsApp Business API support, Rich Communication Services (RCS), customer support, digital communication management, and related services.

These Terms establish the legal relationship between Pauddha Enterprises and every customer, visitor, user, business partner, or organization accessing or using our services.

By continuing to use our services, you confirm that:

  • You are legally capable of entering into a binding contract.
  • You agree to comply with all applicable Indian laws.
  • You agree to comply with Meta Business Messaging Policies.
  • You agree to comply with Google RCS Business Messaging Policies.
  • You accept all future amendments to these Terms.

If you disagree with any portion of these Terms, you should immediately discontinue the use of our services.

2. Definitions

For the purpose of these Terms, the following definitions shall apply:

“Company” refers to Pauddha Enterprises.

“User” means any individual, business entity, visitor, customer, employee, representative, or organization using our website or services.

“WhatsApp Business Platform” refers to the official business messaging platform operated by Meta Platforms, Inc.

“RCS” refers to Rich Communication Services supported by Google and participating mobile network operators.

“Account” means a registered customer profile created to access our services.

“Content” means all text, files, images, videos, documents, messages, logos, trademarks, software, and digital information transmitted through our platform.

“Business Messaging” refers to customer communications sent through approved messaging channels.

“Applicable Law” means all laws, regulations, rules, notifications, and government requirements applicable within India.

3. Acceptance of Terms

By using any service provided by Pauddha Enterprises, you expressly agree to these Terms.

Acceptance may occur by:

  • Registering an account.
  • Using our dashboard.
  • Making payments.
  • Sending or receiving business messages.
  • Connecting WhatsApp Business API.
  • Using RCS Business Messaging.

If you are acting on behalf of a company or organization, you represent that you possess the legal authority to bind that organization to these Terms.

The availability of services may change without prior notice depending upon:

  • Google policy updates
  • Telecom operator regulations
  • Government regulations
  • Technical maintenance
  • Platform availability

Pauddha Enterprises reserves the right to modify, suspend, discontinue, or upgrade any service without creating liability toward users.

5. Eligibility

To use our services, you represent and warrant that:

  • You are at least 18 years of age.
  • You possess legal authority to enter into contracts.
  • You are legally permitted to operate your business.
  • Your business complies with Indian law.
  • Your business activities do not violate Meta policies.
  • Your messaging activities comply with RCS policies.
  • You will provide accurate registration information.

  • You are not prohibited from using messaging platforms by any applicable law.

Businesses operating in regulated industries may be required to submit additional verification documents.

Pauddha Enterprises reserves the right to reject applications that fail verification or violate applicable regulations.

6. Account Registration

Certain services require users to create an account.

When registering, users agree to:

  • Provide true and accurate information.
  • Submit valid business documents where required.
  • Maintain updated contact details.
  • Protect login credentials.
  • Maintain password confidentiality.
  • Notify us immediately regarding unauthorized account access.

Users remain solely responsible for activities occurring under their account.

Pauddha Enterprises may suspend or terminate accounts if:

Multiple registrations intended to bypass platform restrictions are strictly prohibited.

7. User Responsibilities

Users shall:

  • Follow Meta Business Messaging Policies.
  • Follow Google RCS Business Messaging Guidelines.
  • Obtain valid customer consent before sending messages.

Users shall NOT:

  • Send unsolicited advertisements.
  • Promote illegal products.
  • Distribute malware.
  • Transmit viruses.
  • Share obscene or offensive content.
  • Send hate speech.
  • Engage in phishing.
  • Collect unauthorized personal information.
  • Impersonate another person or business.
  • Violate intellectual property rights.
  • Circumvent security controls.
  • Use automated systems for unlawful purposes.
  • Interfere with platform operations.
  • Attempt unauthorized access to systems.

Users remain fully responsible for all content transmitted through their accounts.

8. Payment & Billing Terms

Certain services provided by Pauddha Enterprises may require payment of applicable fees. By purchasing or subscribing to any paid service, you agree to comply with the following billing terms.

Service fees may include, but are not limited to:

  • Platform subscription charges
  • Setup or onboarding fees
  • Integration charges
  • Consultation fees
  • Maintenance charges
  • Messaging usage charges
  • Support service fees
  • Third-party platform charges
  • Applicable taxes under Indian law

All prices are communicated in advance and are subject to applicable Goods and Services Tax (GST) or other statutory levies where required.

Payments shall be made through approved payment methods made available by Pauddha Enterprises.

Unless otherwise agreed in writing:

  • Payments are due before service activation.
  • Delayed payments may result in temporary suspension of services.
  • Outstanding dues must be cleared before service restoration.
  • Failure to make timely payments may lead to permanent account termination.

Users are responsible for ensuring that their payment details remain valid and updated.

Pauddha Enterprises reserves the right to revise pricing, introduce new service plans, or modify billing structures by providing reasonable prior notice through our website, registered email, or customer dashboard.

Continued use of the services after such notice constitutes acceptance of the revised pricing.
